Notwithstanding anything in this Agreement to the contrary, CALLPASS, LLC cumulative liability, including for claims, expenses, damages or indemnity obligations arising out of this Agreement, shall not exceed the Airtime fee income paid by Client to CALLPASS, LLC under the terms of this Agreement. CLIENT BEARS SOLE RESPONSIBILITY TO DETERMINE WHETHER THE USE OF THE DEVICES CONFORMS TO APPLICABLE, FEDERAL, STATE, AND LOCAL LAWS. CALLPASS MAKES NO REPRESENTATION WHATSOEVER OF THE APPROPRIATENESS OF THE CLIENT’S APPLICATION.
